1. General

1.1 The General Conditions of Sale shall govern all transactions made through this Website within territory of Mainland China (i.e. exclusive of Hong Kong SAR, Macau SAR, and Taiwan). Please carefully read the Conditions before ordering the products online, and ensure that you have fully understood them and agreed to be bound. If you agree with the aforementioned Conditions, please click the check box “I have read and agree with this General Conditions of Sale and Return Policies”, then proceed to place an order (“order”) and complete the payment process. Your purchase and order of products on this Website constitutes your awareness of the instructions occurred during the process of ordering and your agreement with Zegna to comply with and be bound by the General Conditions of Sale (“Conditions”).

1.2 Zegna offers for sale on the Website the products to Customers, who are located within territory of Mainland China, on or above the age of 18 years old, have full capacity for civil conduct, buy products for reasons unrelated to their trade, business, entrepreneurial or professional purposes (“Customer”). If Zegna has reasonable cause to suspect that the persons placing the order is not a “Customer”, Zegna is entitled not to process orders placed by persons other than "Customer", cancel such orders or unsubscribe the accounts of persons not a “Customer”.

1.3 Zegna may update these Conditions at any time without prior notice by posting them on this Website. You can view the most current version of the Conditions at any time on this Website. The modified Conditions shall take effect once posted on this Website. For each order you place on the Website, your acceptance of the Conditions in force as of the date of your order is required. The Conditions in effect at the time of your order will govern that transaction. If any provision of these Conditions or part thereof is or becomes illegal, invalid or unenforceable in any jurisdiction, the illegality, invalidity or unenforceability of that provision will not affect the legality, validity or enforceability of the remainder of the provision or the remaining provisions of these Conditions.

1.4 These Conditions may be printed or stored on permanent storage devices, in accordance with the applicable legislation currently in force.

1.5 The computerized data registered by the Website in the IT systems of Zegna establish the terms of the transactions between Zegna and its Customers. In the case of a dispute between Zegna and its Customers relating to a transaction entered into using the Website, the data registered by Zegna are the terms of the transaction and shall constitute the proof of communication, orders and payments between the parties.


2. The Scope of Liabilities

2.1 Save for liability which Zegna cannot by law restrict or exclude, Zegna shall have no liability to visitors to the Website or any third party for any direct, special, indirect, consequential or incidental damages, exemplary or lost profits, or any other damages of any kind even where Zegna has been advised of the possibility of the same whether resulting from access to the Website, inability to access the Website or any information or material directly or indirectly provided through the Website or otherwise, unless the aforementioned losses is due to the gross negligence, deceit or intentional unlawful act of Zegna.

2.2 Zegna will not be liable for any delay or failure to perform any of its obligations under these if such delay or failure is due to causes beyond its control. Theses causes include but not limited to: natural disaster, explosion, flood, fire or accident; war or civil strife; industrial action or stoppage; any form of government intervention; your failure to offer the correct delivery address or notify us of the change of the address. Zegna will inform you within 7 days after the occurrence of such unforeseeable accidents or Force Majeure and will arrange a new delivery date after the accidents end. If such accidents last for more than 2 weeks, you are entitled to cancel the order.


3. How to buy the products

3.1 The products offered for sale by this Website are only and exclusively the ones displayed on the Website when the order is placed, as described in the relevant product information sheet.

3.2 While every effort is taken to try to ensure that the Zegna products in the photographs displayed on the Website are representatives of the original products, it remains in any case understood that, the images included in the product information sheet may not be representatives of all of the specifications of the product on account of the differences in screens and systems used by Customers for accessing the Website or difference batches of products or otherwise. Therefore, the pictures displayed on the Website are only for reference purpose.

3.3 Customer can place an order by duly filling-in the order form made available on the Website and sends it in accordance with the indications provided in the Website, after having carefully reviewed these Conditions, the product specifications, the relevant price (inclusive of all applicable taxes and charges), shipping costs (including the ancillary costs that may be incurred in case a shipping and delivery method quicker and/or different from the standard one is chosen). Customer shall ask Zegna if he/she wishes to receive the invoice for the purchased product.

3.4 Customer may correct any errors before placing the order by correcting the input within the order form. The Customer shall take the liability by his or herself caused by the false, incorrect or incomplete personal information offered by him or her or against of the interest of any other third party. Zegna is entitled to claim for compensation from the Customer if it suffers from it. If you have any problem with the order, please contact the Customer Care Center in accordance with Article 8 hereof before placing the order.

3.5 When the Customer places the order and completes the total payment, the order will be confirmed via an email to the email address associated with the Customer’s account. This shows the sale contract is established between both Parties subject to the product in the order (the “Contract”) in accordance with the Conditions. An email will be sent to you when the products you ordered are delivered.

3.6 Considering the products displayed and sold on this Website are under restrictions of the state of supply, and at times, errors may exist, especially in case of simultaneous orders of the same product by several Customers or the purchases of customized products. Therefore, you hereby agree that in case a product is not available or the price or description is inaccurate or otherwise after you have placed your order, we will inform you by email or by telephone as soon as possible and we are entitled to unilaterally terminate the Contract under no conditions without any liabilities to you.


4. Price and Terms of payment

4.1 The prices indicated on the Website are inclusive of VAT. Customer shall be informed in advance of shipping costs or fees, if any, through the Website.

4.2 The payments can be made only through bank card, Alipay, WeChat pay and any other methods designated by Zegna, and the transaction will be processed through a secure server selected by Zegna.

4.3 Under no circumstances and at no stage of the payment process will the details of the card used be disclosed to Zegna. Customer payment details will be sent directly, in a secure manner, to the Website of the financial institution in charge of the transaction. Since none of such data will be stored in Zegna’s files, Zegna will not be liable for fraudulent and unlawful uses, if any, made by third parties of the Customer’s card during the payment procedure.


5 Delivery of the products and relevant expenses

5.1 Zegna, its suppliers and its logistics service providers shall deliver the products purchased by Customer at the address indicated in the order, at the cost specifically indicated on the Website before the order is made.

5.2 Customer may decide to personally collect the products at one of the designated Zegna retail stores within territory of mainland China (where available). A complete list of such retail stores can be found on the Website. For in-store collection, Customer will receive an e-mail informing him/her that the product has arrived at the retail store and is ready for collection. The Customer must collect the product within twenty (20) calendar days from date of the confirmation email. To collect the products the Customer must provide a copy of the confirmation e-mail together with proof of identity.

5.3 If the Customer fails to collect the product within the time limit aforementioned, Zegna is entitled to terminate the Contract after notifying the Customer by sending a text message or e-mail and the Customer will be entitled to a full refund of the price.

5.4 In case that the product is delivered by a third party delivery company, if there is a problem with your order, including but not limited to the circumstances that the product is damaged or an item has not been received, please let us know as soon as possible by contacting the Customer Care Center team as detailed specified under Article 8 of these Conditions.


6 Right of withdrawal

6.1 Subject to the detailed rules and policies regarding the withdrawal under these Conditions, Customer is entitled to withdraw from the purchase agreement for any reason, without penalty and without the need to give any explanation, within seven (7) calendar days from the date of delivery of the products, except for those products of underwear, cosmetics and perfumes, electronic devices, watches, customized products or products which cannot be returned or exchanged due to their nature and Customers are clearly informed of this situation when submitting the order.

6.2 Customer shall exercise the right of withdrawal by filling in the blanks of the form provided in the packaging of the products delivered (" Withdrawal Form"), and submitting the Withdrawal Form to Zegna within the timeline specified in 6.1.

6.3 In the event of withdrawal, Customer shall dispatch the goods back to Zegna within seven (7) calendar days from the date of delivery of the products, using one of the following options:

6.3.1 Customer needs to call Zegna Contact Center to initiate the return requirement, and prepare the parcel per the guidance from Contact Center and pass to courier which assigned to them (redelivery is paid for by Zegna );

6.3.2 Send the product/s to the address offered by Zegna Contact Center means of the courier chosen by the Customer (by using a different courier than the one specified by Zegna you are responsible for the additional cost of redelivery); Related potential risks before arriving Zegna specified place will be taken by Customer.

6.3.3 Redelivery in person to the store address in the Withdrawal Form (the Customer may bring the products along, the Withdrawal Form and personal identification to the returns store address).

6.4 The product must be returned along with its attachments, supplements, sales receipt, invoice (if any), free gifts (if any) and the original packaging (including the packaging materials and the documents, if any, accessories, labels, tags, seals, etc.) and the products returned must be new and non-used, in their original saleable condition and packaging, and must show no signs of wear, alteration, washing or dirt.

6.5 Withdrawal may only be exercised for a complete product, partial withdrawals (i.e. accessories, complements, etc.) are not permitted.

6.6 No matter which method under Article 6.3 is chose by the Customer for return, the products will be accepted for return by Zegna only when they are received by Zegna and fulfill all the requirements provided in Article 6.4 and 6.5. After receiving the product, Zegna will use its best endeavor commercially reasonable to notify the Customer whether the return is accepted. Zegna will refund to Customer the whole amount paid for the product(s), including standard shipping costs incurred in relation to the returned products stipulated in Article 6.3.1(this will not include any additional cost incurred by using an alternative service than the courier stated in the Withdrawal Form) within seven (7) business days after the aforementioned notice is sent.

6.7 Unless otherwise provided by the law, the amount charged to the Customer for the product(s) will be returned to the same payment card used by Customer in the initial transaction. No amount shall be charged to Customer in relation to the refund. Zegna may withhold the refund until the returned product is properly received by Zegna.

6.8 Any products which Zegna found are inconsistent with the terms and conditions set forth herein will be returned to you after notifying you through text message or e-mail. No refund will be made so please properly and carefully keep the products.

6.9 In the event that the right of withdrawal is forfeited, Zegna shall send back to Customer the purchased product, and the Customer shall pay for the shipping costs.


7 Warranties

7.1 All products sold by Zegna are covered by relevant quality guarantee based on applicable laws. The return policies provided in Article 6 hereof shall not impair your lawful rights relevant to the product quality.

9 Privacy

9.1 Any personal data collected when an order is placed, shall be processed for the sole purpose of satisfying Customer’s express requests, in compliance with the legislation applicable to privacy and with the Privacy Policy available on the Website. Other processing, if any, of such data shall be carried out only with Customer’s express consent.


10 Applicable Law

10.1 The sale agreement under these Conditions and its performance are governed by the laws of the People’s Republic of China. Any dispute arising out of or in connection with these Terms should be settled through amicable negotiation, failing which, either party may submit the dispute to Shanghai International Arbitration Center (SHIAC) for arbitration according to the then-effective arbitration rules of SHIAC. The arbitral award is final and binding on both parties.
